As part of the Invisible Wall strategy, USCIS has started issuing RFE’s (Requests for Evidence) and denials of applications and petitions related to English translations that are not properly certified. RFE’s result in processing delays, and, as you know, denials will result in the loss of all filing fees, time, and possibly your valid immigration status. With this in mind, applicants and petitioners who are submitting foreign language documents would be well advised to become familiar with the requirements of the regulations found at 8 CFR ยง103.2(b)(3).
In short, this regulation provides that all foreign language documents must be accompanied by:
- a full English language translation, AND
- a certification statement from the translator, in which the translator specifically certifies that the translations is complete and accurate and that the translator is competent to translate from the foreign language into English.
It is also recommended that the certification lists or names the documents that are being translated.
